Nelly may not be off the hook for an alleged rape after all. The rapper was accused of raping a 21-year-old woman on his tour bus earlier this month. A week later, the woman's attorney said she would not testify against Nelly, but police have made it clear they are not dropping the case.

On October 7, Nelly, whose real name is Cornell Iral Haynes Jr., was arrested by police in Auburn, Washington after he allegedly raped a woman he met at a nightclub. According to TMZ, Nelly asked the unnamed woman to accompany him to his tour bus that was reportedly parked in a nearby Walmart parking lot.

She initially told police she turned down the rappers advance but he told her to "shut up" and raped her.

Police ready to meet with prosecutors

The woman's attorney has confirmed that her client will not testify in any criminal proceedings against Nelly, but police in Auburn will not put the case to rest. Although they have yet to file charges against him, a new report from TMZ states that authorities plan to present the case to prosecutors as soon as this week.

Billboard reports that Attorney Karen Koehler issued a statement on October 13 that confirmed her client wanted to stop the investigation. The woman who initially accused Nelly of rape doesn't think she can stand up against a celebrity and no one will believe her story.

Even without her testimony, police feel that they may still have a case. TMZ's sources state that police in Auburn are still obtaining evidence and won't be deterred by the fact that Nelly's accuser doesn't want to testify against him.

Nelly's attorney speaks out

Although the Auburn police are moving forward with the case, the rapper's attorney, Scott Rosenblum tells The New York Daily News he expects the case against his client to be closed.

He is currently working with a private investigator to help prove the woman is looking for money and fame. Although the alleged rape is still under investigation, Attorney Rosenblum is confident Nelly will not be charged.

Clearly, Nelly trusts his attorney and is not letting possible rape charges get in the way of his performance schedule.

On Saturday, one week after he was arrested, the 42-year-old rapper performed at the Coral Sky Amphitheatre in West Palm Beach, Florida.

After the show, TMZ spotted him hanging out at the Rockwell Nightclub with his friend and fellow rapper, T.I. who told his buddy to put the "bulls***" behind him.
